Booking Terms

Contract

The booking contract is between the Owner and the Hirer.

The contract effected between the Hirer and the Owner confers on the Hirer the right to occupy the property for the period agreed for holiday use only and does not give the Hirer any security of tenure under the terms of the Housing Act 1988 pursuant to which the occupation shall be deemed to be by way of an excluded tenancy.

It is agreed that this Agreement is not an assured tenancy and that no periodic tenancy will start at the end of the Letting Period. As a holiday letting this Agreement is excluded for the purposes of the Protection from Eviction Act 1977.

The Owners have the right to decline handing over the property to the Hirer if there are justifiable grounds to believe that the Hirer or any of the persons included in the booking contract are not suitable to occupy the property. A 50% refund of any monies paid will be given. The Hirer will not be entitled to any compensation or damages for cancellation of the booking for this reason.

The Owner cannot be held responsible for loss or damage to any belongings or for injury sustained by the Hirer or members of his or her party during their stay at the accommodation.

The Owner or any agents of their choice shall be allowed the right of entry to the property at all reasonable times for the purposes of inspection or to carry out any necessary repairs or maintenance.

The use of any additional amenities brought by the Hirer is entirely at the user’s risk and no responsibility can be accepted by the Property Owner for any death or personal injury (save to the extent that such death or personal injury was caused by the negligence of the Property Owner). No liability for any other loss or damage in connection with the use of such amenities is accepted.

Specific conditions and restrictions applying to the property will be mentioned in individual property description or additional documentation, and will be deemed to form part of these Terms and Conditions.

A person who is not a party to this Agreement cannot enforce any of its terms under the Contracts (Rights of Third Parties) Act 1999.

Arrivals/Departures

Rentals commence, unless otherwise agreed, after 16:00 on the day of arrival and terminate at 10:30 on the day of departure to allow the changeover to commence.

No early or late check in/check out unless otherwise agreed.

Occupancy

Maximum occupancy of the house is 5 people. Unless otherwise agreed, under no conditions are additional people allowed to stay overnight in the property.

Payments

All payments should either be;

  • via bank transfer with account details provided as required, or
  • via online booking platform (HomeAway or Airbnb)

Fuel

Heating, hot water and electricity is included in the rental price.

Housekeeping

The Hirer is responsible for the condition of the property and its entire contents during the hire period, fair wear and tear is accepted. The Hirer will make good any damage or loss and leave the property and contents in a clean and tidy condition. The person held responsible for the hiring party will be the person who made the booking. The Owner reserves the right to make a charge for extra cleaning if the property is not left in a satisfactory condition.

A security deposit of £250 is required prior to the commencement of each holiday which is returnable to the Hirer upon confirmation from them or their agent that:

  • No damage is made to property or its contents beyond normal wear and tear.
  • All debris, rubbish and discards are placed in the rubbish or recycling bins in the bin stores.
  • Soiled dishes are placed in the dishwasher & run before departure.
  • The property is left clean and tidy.
  • Keys are left in the lock box or returned to the Owner at Two Oaks.
  • There is no evidence (seen or smelt) that cigarettes or tobacco has been smoked in the house. In the event that a deep clean is required due to smoking, an additional charge will be made and the Hirer is responsible for payment in full.
  • No linens or towels are lost or damaged.
  • The Hirer has not been evicted by the Owner or representatives of the Owner, or the local law enforcement.
  • No pets are permitted.

The security deposit will normally be returned within 1 week of the departure date.

Linens and Towels

The Owners will ensure that beds are made prior to arrival plus towels and tea towels will be provided for the duration of the stay. For stays of 14 days or longer these will be refreshed on a weekly basis.

All linens and towels must be left on departure.

Storage of bikes and other outdoor pursuit equipment

Bikes and other outdoor equipment in the outdoor storage. For your convenience 2x padlocks are provided. Bikes or other outdoor equipment of this nature incl. life jackets/preservers should not be stored or dried in the house.

The Owners will not be liable for any theft or damage incurred to bikes or outdoor pursuit equipment during the Hirers stay.

Left property

The Owners cannot guarantee safe return of any items left by Hirers in the property but will take reasonable steps to do so. Any cost incurred e.g. postage should be reimbursed by the Hirer to the Owner in full.

Payment Schedule

A 20% reservation deposit is requested to secure the booking. Balancing payments are required 3 weeks prior to arrival.

Cancellations

In the case of cancellation on the part of the Hirer, any monies paid will be returned in full.

Non-availability of Property

Should the property become unavailable the Hirer will receive a full refund of any monies paid (or a proportion in the event of curtailment). The Owner reserves the right to alter or withdraw without prior notice any facilities and/or amenities which have been advertised, where reasonably necessary due to repairs, maintenance or any other circumstances that impact the ability of the Owner to rent the property.

Biodisc Sewage treatment plant

The property uses its own sewage treatment plant for waste. Under NO circumstances should manmade products other than toilet roll be flushed away. In the event that there is evidence that nappies, sanitary towels etc. have been flushed a cost of £250 will be levied to the Hirer to enable a system clean.

Termination

The Owner or their agent reserve the right to terminate the rental agreement and request the immediate departure of all persons from the property in the event of a serious breach of the terms of this agreement. The breach may include but is not limited to the following events:

  • Serious damage to the property.
  • A criminal or illegal act.
  • Unreasonable or abusive behaviour or,
  • Excessive noise which can adversely affect the rights of the Owner being able to continue to operate the property for lettings, or involve authorities or police in any form of complaint investigation.

Falsified Bookings

Any booking obtained under false pretence will be subject to forfeiture of all payments made and the party will not be permitted to check in.

Data Protection

The Hirer’s details will not be sold or passed on to any third parties.

Disclaimer

Use of the property is at the Hirer’s risk. All residents must take extra care, especially the supervision of children throughout the boundaries of the property and its surroundings.

Other

Travel/holiday insurance is recommended.

Terms and conditions of hire are applicable 01/01/2022. The Owners reserve the right to amend these at any time.
